本服务条款("条款")是你与成都图样图森科技有限公司("我们")之间就使用手指鼓 Finger Drum("本 App")达成的协议。下载、安装或使用本 App,即表示你同意受本条款约束;若不同意,请勿使用本 App。These Terms of Service ("Terms") form an agreement between you and Chengdu Tuyang Tusen Technology Co., Ltd. ("we", "us") regarding your use of Finger Drum (the "App"). By downloading, installing or using the App, you agree to be bound by these Terms; if you do not agree, do not use the App.

本 App 免费下载,核心功能可免费使用。部分进阶内容或功能通过应用内购买("内购")解锁。所有购买通过 Apple App Store 或 Google Play 进行,付款、计费与退款适用相应商店的条款与政策。The App is free to download and its core features are free to use. Certain advanced content or features unlock via in-app purchases ("IAP"). All purchases are processed through the Apple App Store or Google Play, and payment, billing and refunds are subject to those stores' terms and policies.
除适用法律或商店政策另有规定外,内购一经完成通常不可退款。请在购买前确认所购内容。Except as required by applicable law or store policy, IAP are generally non-refundable once completed. Please confirm your purchase before buying.

本 App 及其音频引擎、界面设计、内置音色包、商标与标识等,均为我们或相应权利人所有,受相关法律保护。本条款未明确授予的权利均予保留。内置音色包仅授权你在本 App 内使用,你创作的作品可自由使用。The App and its audio engine, interface design, built-in tone packs, trademarks and logos are owned by us or the respective rights holders and are protected by law. All rights not expressly granted are reserved. Built-in tone packs are licensed for use within the App; works you create with them are yours to use freely.
本 App 通过 Apple App Store 与 Google Play 分发,你对本 App 的使用还须遵守相应商店的条款。本 App 使用 Google Firebase 等第三方服务用于稳定性与分析(详见隐私协议)。我们对第三方服务的可用性或行为不承担责任。The App is distributed through the Apple App Store and Google Play, and your use is also subject to those stores' terms. The App uses third-party services such as Google Firebase for stability and analytics (see our Privacy Policy). We are not responsible for the availability or conduct of third-party services.

We do not warrant that the App will be uninterrupted or error-free, or that audio latency will reach a specific figure on all devices — real-world latency depends on your device and system.
在适用法律允许的最大范围内,我们不对任何间接的、附带的、特殊的或后果性的损害(包括数据丢失、利润损失)承担责任。在任何情况下,我们就本 App 产生的累计责任不超过你在过去十二个月内就本 App 向我们支付的金额(如有)。To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential damages (including loss of data or profits). In no event shall our aggregate liability arising from the App exceed the amount, if any, you paid us for the App in the preceding twelve months.
若你违反本条款,我们可暂停或终止你使用本 App 的许可。你可随时通过卸载本 App 终止本协议。终止后,许可即行失效;按其性质应继续有效的条款(如知识产权、免责声明、责任限制)仍然有效。We may suspend or terminate your license to use the App if you breach these Terms. You may terminate this agreement at any time by uninstalling the App. Upon termination the license ends; provisions that by their nature should survive (such as intellectual property, disclaimers and limitation of liability) remain in effect.
本条款受中华人民共和国法律管辖并据其解释(不含冲突法规则)。因本条款引起的争议,应首先通过友好协商解决;协商不成的,提交我们所在地有管辖权的法院处理。本条款亦不影响你作为消费者在当地法律下享有的强制性权利。These Terms are governed by and construed under the laws of the People's Republic of China (excluding conflict-of-law rules). Disputes shall first be resolved through friendly negotiation; failing that, by a competent court at our place of business. These Terms do not affect mandatory consumer rights you may have under your local law.
我们可能不时修订本条款。重大变更会在 App 内或本页面公示并更新日期。变更生效后继续使用本 App,即表示你接受修订后的条款。We may revise these Terms from time to time. Material changes will be posted in the App or on this page with an updated date. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
